Call of Duty, Counter-Strike, Rainbow Six: Siege and esports giants, FaZe Clan, are being sued for trademark infringement.
FaZe Clan is one of the biggest esports teams in the world, covering almost every competitive game imaginable. However, they are now being sued by Faze Apparel, who claim infringement of their copyright.
While this may not sound like a big deal to the average player, it could spell bad news for the esports team; resulting in them being forced to pay millions back in damages and legal fees.
What is the claim?
On May 22nd, the California District Judge granted the start of proceedings, one that will prohibit FaZe from selling any of their apparel with the FaZe logo on it.
The claimants are seeking treble damages, attorney fees, and enhanced statutory counterfeiting damages of up to $2 million per counterfeit mark, according to the documents.
Finally, they also want their trademark upheld.
Remarkably, FaZe Clan had their trademarks put in place in 2013 but were rejected due to confusion with Faze Apparel. However, they were later allowed to use ‘FaZe Clan’ on videos, video games and apparel.
The clothing website pushed several cease claims throughout 2015-2016, and FaZe even changed to using ‘Red Militia’ briefly during this period.
Does FAZE Apparel have a claim?
It certainly looks that way inclined. FAZE Apparel was founded back in 2007 and had been selling both online and in stores. Most importantly is the fact that they had trademarks in place before the esports team secured theirs.
If your copyright has been infringed and the party in question is damaging your name, but also your right to earn, then you’ve got a pretty substantial claim.
What can FaZe Clan do?
Well, according to legal documentation, they have made a countercharge, claiming that FAZE Apparel should have their trademarks cancelled.
What happens if FaZe Clan lose?
As they are a multi-million dollar esports team with ties to the likes of SteelSeries, G-Fuel and Scuf Gaming, fees may not cause the team to cease operations.
The problem arises when selling branded clothing, a key way for players to support (and advertise) the clan. As they will need to re-brand, it would cost them dearly in the end.
